28歲的何女士因婚後出軌事件近日受到社會關注。據中國裁判文書網公開資料顯示,何女士在婚後第二年與自己的伴郎鄭先生發生婚外情,兩人以夫妻名義共同生活,並育有一子。今年6月26日,兩人因涉嫌重婚罪被公安機關逮捕。12月7日,柞水縣法院已對此案作出判決。

何女士於2019年與程先生在當地民政局登記結婚,婚禮上鄭先生擔任伴郎。婚後,由於程先生長期外出打工,何女士在婚後第二年開始與鄭先生以夫妻名義同居。2022年12月,兩人育有一子,何女士分娩時,鄭先生以配偶身份簽署相關醫療文件。2023年2月,兩人甚至公開為孩子舉辦滿月宴,邀請雙方親屬參加,並由鄭先生承擔生活費用,何女士與孩子一直在柞水生活。然而,這段重婚關係在2023年3月29日被迫終止。當時,鄭先生因非法狩獵罪被判處有期徒刑十個月並收監,兩人無法繼續共同生活。

法院在審理後認定,何女士已有合法配偶,鄭先生明知其婚姻狀況仍與其以夫妻名義共同生活並生育子女,其行為已構成重婚罪。最終判決結果顯示,何女士犯重婚罪,判處有期徒刑一年,緩刑二年;鄭先生犯重婚罪,判處有期徒刑十個月。此案引發社會關注,不僅涉及婚姻忠誠問題,也對婚姻法規範及法律責任起到警示作用。案件的公開審理和判決再次提醒公眾,重婚行為在法律上具有明確的刑事責任。

A 28-year-old woman, Ms. He, recently drew public attention due to a marital infidelity case. According to documents published on China’s Judicial Documents website, Ms. He engaged in an extramarital affair with her former groomsman, Mr. Zheng, in the second year of her marriage. The two lived together under the pretense of being husband and wife and had a child. On June 26 of this year, both were arrested on suspicion of bigamy. On December 7, the Zhashui County Court issued a verdict in the case.

Ms. He married Mr. Cheng in 2019, registering their marriage at the local civil affairs bureau, with Mr. Zheng serving as a groomsman at the wedding. After the marriage, because Mr. Cheng often worked away from home, Ms. He began living with Mr. Zheng as a couple in the second year of her marriage. In December 2022, they had a son, and Mr. Zheng signed the relevant medical documents at the time of birth, presenting himself as the child’s spouse. In February 2023, the couple even held a full-month celebration for the child, inviting relatives from both families. Throughout this period, Ms. He and her son lived in Zhashui County, with all expenses covered by Mr. Zheng.

The bigamous relationship ended on March 29, 2023, when Mr. Zheng was sentenced to ten months in prison for illegal hunting and taken into custody, making it impossible for the couple to continue their cohabitation.

The court determined that Ms. He had a legally recognized spouse and that Mr. Zheng knowingly cohabited with her as a husband while she was still married, even fathering a child with her. Their actions constituted the crime of bigamy. The court’s final verdict sentenced Ms. He to one year in prison, suspended for two years, and Mr. Zheng to ten months in prison.

The case has attracted social attention, highlighting not only issues of marital fidelity but also the legal consequences of bigamy under Chinese law. The public trial and verdict serve as a reminder that engaging in bigamous relationships carries clear criminal responsibility.
