隨後的日子裡,林女士的工作也受到直接衝擊。2022年7月30日,林女士因網路謠言被所在公司罰款5000元,事業發展遭受阻礙。面對接二連三的打擊,她開始自行尋求法律維權的途徑。到2023年5月8日,林女士通過社交媒體鎖定造謠者黃某,並配合警方確認其身份。經過多方努力,雙方於2023年7月10日達成調解協議,黃某承諾公開道歉並賠償林女士20萬元。然而,黃某未按協議履行,結果在2023年7月12日被行政拘留10日,並處罰款500元人民幣。
法律程序並未因此中止。2024年5月,法院一審判決黃某必須公開道歉並支付20萬元賠償金。黃某提出上訴,稱其與林女士為“戀人關係”,但上訴被駁回。二審於2024年8月維持原判,黃某需在省級報刊公開道歉並賠償林女士20萬元。然而,由於黃某名下無財產可供執行,2025年5月案件正式結束,林女士僅獲登報道歉,賠償款仍未落實。即使在2025年7月黃某因違反協議被司法拘留15天,20萬元賠償依然未被執行。
至2025年11月29日,林女士為獲得賠償所申請的執行懸賞仍未獲法院批准。整起事件歷經三年的漫長維權,她雖然在法律上勝訴,但因被告無財產可執行,實際上仍未能獲得任何經濟補償。這起案件凸顯個人隱私被網路造謠侵害的嚴重後果,以及在法律維權與實際執行之間可能出現的落差。

The incident began on July 17, 2022, when she discovered that her personal information and photos had been posted by a defamer, Huang, on foreign websites, accompanied by explicit and offensive text. The false content not only violated her privacy but also seriously damaged her reputation. As a result, Ms. Lin fell into depression, which ultimately led to the breakdown of her marriage and the loss of her job. She reported the matter to the police immediately, but authorities were unable to file a case due to difficulties in collecting evidence from foreign websites.
The defamation also had direct repercussions on her career. On July 30, 2022, she was fined 5,000 yuan by her employer because of the online rumors, further hindering her professional development. Determined to defend her rights, Ms. Lin began pursuing legal action. On May 8, 2023, she successfully identified Huang through social media and cooperated with the police to confirm his identity. By July 10, 2023, both parties reached a mediation agreement in which Huang agreed to issue a public apology and compensate Ms. Lin 200,000 yuan. However, Huang failed to fulfill the agreement, and on July 12, 2023, he was administratively detained for ten days and fined 500 yuan.
The legal process continued. In May 2024, the court ruled in the first instance that Huang must publicly apologize and pay Ms. Lin 200,000 yuan in compensation. Huang appealed, claiming he and Ms. Lin were “in a romantic relationship,” but the appeal was rejected. The second instance in August 2024 upheld the original verdict, requiring Huang to apologize in a provincial newspaper and pay the compensation. However, because Huang had no assets to enforce the payment, the case was effectively closed in May 2025, leaving Ms. Lin with only a public apology and no compensation. Even after Huang was judicially detained for 15 days in July 2025 due to noncompliance, the 200,000-yuan compensation still remained unpaid.
As of November 29, 2025, Ms. Lin’s application for an enforcement reward to recover the compensation has yet to be approved by the court. After three long years of legal struggle, she has won the case in court, but in practice, she has still received no financial restitution. The case highlights the severe consequences of online defamation on personal privacy and underscores the gap that can exist between legal judgment and actual enforcement.
